Bob Patterson has spent the last 30 years helping businesses resolve difficult problems. Through his years of experience as a trial lawyer and his involvement in firm governance and community leadership, Bob combines business acumen with courtroom experience to assure his clients make a fully informed decision about the best strategy to deploy for a particular problem.

Trial Work : The key to evaluating the risk of litigation is an understanding of how that risk will play out in the courtroom, and Bob has tried numerous cases, both jury and non-jury, to conclusion. He has extensive jury experience trying cases that range from "slip and fall" to products liability to allegations of breach of fiduciary duties by partners in an investment partnership.

Risk Management : Somewhat uniquely for a trial lawyer, Bob knows business from the management side. In addition to serving as an outside general counsel for many companies, he served as the managing partner of his law firm for six years. Bob is regularly involved in a "corporate divorce" in which owners of closely held business need to separate, and he recently engineered the settlement of a dispute between principals in a large hedge fund without suit. Several years ago, he was one of the lead lawyers on a team that engineered the tax-free split up of a billion dollar real estate company, a negotiation that required evaluation of the risks of already pending litigation while negotiating a business deal with drastic tax consequences should it have failed. Bob understands business, and how litigation can impact a business.

Bob's work in the health care field provides an example of the breadth of his ability to assist businesses in difficult situations as he has represented health care providers in a variety of situations. He has defended health care providers in qui tam, False Claims Act, cases. He has represented several hospital companies in the resolution of claims arising after the purchase of a hospital. He recently successfully defended a hospital in one of the nationwide string of lawsuits alleging that not-for-profit hospitals have failed to render charity care commensurate with their public duties. He has consulted with hospital companies on the management of medical malpractice claims. While he does not specialize in medical malpractice, he is often hired to defend complex medical malpractice cases involving large claims.

As a result of this experience, Bob is listed in The Best Lawyers in America® 2008, for his commercial litigation practice. He also is included in Chambers USA: America's Leading Lawyers for Business 2008, Business Tennessee's 2008 "150 Best Lawyers", the Lawdragon 3000, Benchmark: Litigation 2008 and Mid-South Super Lawyers 2007 for business litigation.

Bob is active in civic and community affairs. He currently serves on the boards of the Nashville Convention and Visitor's Bureau and the Board of the Monroe Carell Jr. Vanderbilt Children's Hospital, having served two years as the chair of that board, and the board of his children's swim team, Nashville Aquatic Club. He has formerly served as Counsel to the Chamber of Commerce, was a participant in Leadership Nashville and has served on a number of charitable and civic boards, including Junior Achievement and University School of Nashville. In addition, he has served in a variety of leadership positions within the firm, including Litigation Section Leader, Administrative Partner and, from 2000 through 2006, Managing Partner. He is a member of the Nashville, Tennessee and American Bar Associations among other professional organizations.

Bob Wood has been with Boult Cummings since 1983. He is a member of the firm's Board of Governors and has served as the firm's Managing Director. Bob is also a Team Leader for the Real Estate Finance Practice Team in the firm's Real Estate Section.

He is primarily involved in commercial real estate and commercial lending transactions. In addition, he is involved in the representation of other corporate and commercial clients, including clients involved in the manufacturing, communications, entertainment and construction industries.

Bob's real estate-related practice involves the representation of institutional lenders, real estate developers and investors in real estate finance, acquisition and development transactions. Bob also represents a number of title insurance companies and is involved in commercial lease negotiations, representing both landlords and tenants. He has represented a number of commercial and residential owners associations. Bob has lectured frequently on real estate law and title insurance matters.

He is an active member of the community, serving in a variety of organizations. Bob is president of the David Lipscomb University Business Leadership Council and serves on the university's Board of Trustees. He is also on the Board of Elders for Harpeth Hills Church of Christ and serves on the Board of Directors for Rocketown, Inc., a nonprofit organization. He is an Associate Member of the American Land Title Association, a member of the Tennessee Land Title Association, and a Fellow in the American College of Mortgage Attorneys.

Bob is a member of the Nashville (Real Estate Subcommittee), Tennessee and American (Title Insurance Subcommittee and Business Law) Bar Associations. Bob is included in Chambers USA: America's Leading Lawyers for Business 2008 for his real estate practice, The Best Lawyers in America® 2008 for real estate law, Mid-South Super Lawyers 2007 for real estate, and the Nashville Business Journal’s 2006 Best of the Bar.

John Remsen, Jr. is a nationally recognized speaker and author on law firm marketing topics.

 

He has been a featured speaker at over 100 national and regional conferences of the Legal Marketing Association (LMA), the Association of Legal Administrators (ALA), and numerous state and local Bar associations. In addition, he has been chosen to moderate dozens of panel presentations -– often featuring managing partners and/or general counsel -- for these and other organizations.

 

His articles have appeared in such well-respected publications as ABA Journal, Asian Lawyer, For the Defense, Legal Management, Marketing for Lawyers, Marketing the Law Firm, Managing Partner, Rainmaker’s Review, Florida Bar News, Florida Lawyer, Lawyers Weekly, New York Law Journal, Texas Lawyer and Wisconsin Lawyer.

 

John has served on the national Board of Directors of the Legal Marketing Association (LMA) and was President of its Southeastern chapter for three years. In addition, he was Executive Editor of Strategies, LMA’s monthly newsletter.

 

A native of West Palm Beach, Florida, John holds an MBA degree from The University of Virginia (1985) and a Bachelor’s degree in Business Administration from the University of Florida (1980).


Peter A. Giuliani - Smock Sterling - USA

Peter Giuliani is a Partner at Smock­Sterling Strategic Management Consultants. His law firm management experience spans more than 39 years, both as a management consultant to law firms and other professional service firms (32 years), and as Executive Director of Cummings & Lockwood, a 180-lawyer law firm based in Stamford, Connecticut (7 years). His functional specialties include strategic planning; financial management and law firm economics, administrative and technology infrastructure planning; strategic mergers, acquisitions, and divestitures; and practice group management. Peter has been a featured speaker or panelist addressing law firm strategy and financial issues on well over 100 occasions – and is always highly rated by those in attendance.

Prior to joining Cummings & Lockwood, Peter was a consultant with four major consulting firms, including Altman Weil, Pensa International, Arthur Young, and Price Waterhouse. Peter has an A. B. in Economics and Philosophy from The College of the Holy Cross and an MBA in Managerial Economics and Finance from Cornell University. He is also a Certified Public Accountant (inactive status) and a Certified Management Consultant. In 1998, Peter was elected a Fellow of the College of Law Practice Management in recognition of his career-long dedication and contribution to improving the management of law firms.
