The credit crunch has returned corporate restructuring and insolvency procedures to the forefront of the professional advisor’s tool kit, but since the last recession there has been an explosion in cross-border commercial activity, fed by the increasing facility of global communication. This means that corporate recovery work too is going global.
But bankruptcy remains highly jurisdictionally focused and rare indeed is the insolvency professional able (or authorised) to practise in multiple jurisdictions. Add to that the different roles taken by lawyers and accountants in insolvency procedures in different jurisdictions and the prospects for an exponential increase in complexity as an insolvency proceeding crosses national boundaries become clear.
