In recent years, a growing number of legal process outsourcing companies, primarily in India, have offered their services to handle the most labor-intensive aspects of U.S. legal matters, especially patent drafting, legal research, and document review in large-scale litigation.  As the global economic downturn became more turbulent, many were predicting that it soon may be commonplace for corporate counsel and law firms to turn to legal outsourcing as a viable solution to increase efficiency and cut costs. However, have recent headlines from India shaken people’s faith in outsourcing or raised new doubts about the wisdom of having someone else handle elements of a client’s vital legal work?

 

The presentation will begin with an overview of outsourcing, including a description of the reasons behind the growth of legal process outsourcing companies, the type of work they perform, and their qualifications. The presentation next will focus on professional responsibility issues, including a discussion of an American Bar Association ethics opinion detailing lawyer responsibilities when outsourcing legal work, as well as recent policy initiatives from the ABA, the largest voluntary professional membership organization in the world.  The presentation will conclude with an analysis of the advantages of legal outsourcing and its liabilities.
